$1 Million verdict for a soft tissue, non-surgical threshold case

In March of 2008 Attorney Jerry Lefebvre from Okeechobee and I presented a soft tissue injury case to an Okeechobee jury.
The Plaintiffs’ had previously filed a Proposal for Settlement for $60,000.00.
This was also a threshold case where Orthopaedic Surgeon, Dr. Jeffrey Penner and Neuro Surgeon, Dr. Jordan Grabel testified that the Plaintiff had not sustained a permanent injury in the motor vehicle accident.
One of the issues was how to affectively present to the jury the magnitude of the economic and non-economic damages.
We decided to video the various medical & physical aspects of the Plaintiff’s job, personal life and leisure activities which she could no longer do because of her injuries.
Her teenage son had taken over her duties in the family septic tank business.
We showed the jury the son performing the physical duties required of the job.
Also, we showed the jury video of the Plaintiff racing her stock car within a year of her accident date.
The jury obviously believed the Plaintiffs’ version of the case and awarded damages in the amount of $1,000,000.00.
